Afterglow — Mobile Sandbox MMORPG
§1. General Provisions
These Terms of Service ("Terms") define the terms and conditions of using the Afterglow application and all related services ("Service"), as well as the rules for accessing content, creating accounts, making purchases, and interacting with other users.
Afterglow is a mobile sandbox MMORPG set in a post-apocalyptic American Southwest. The Service allows you to maintain your account and play Afterglow online.
The owner and operator of Afterglow is Shadow Council Pty Ltd, email: [email protected] ("we," "us," "our," or the "Service Provider").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Definitions:
- Application — the Afterglow mobile application and any associated web services, managed by the Service Provider.
- Service — the full range of services provided electronically by the Service Provider, including but not limited to: access to the game, account management, in-game communication, marketplace functionality, and purchase processing.
- User — any individual who accesses or uses the Application.
- Account — an individual User's account within the Application, containing the User's data and enabling the use of the Service.
- Virtual Content — any in-game items, virtual currency, characters, character progression, equipment, blueprints, resources, skins, cosmetics, subscription benefits, and any other digital content acquired, earned, crafted, or purchased within the Service.
- Subscription — a recurring paid plan that provides enhanced access to certain features of the Service.

§2. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and the age of majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf before you may use the Service.
By using the Service, you represent and warrant that you meet these eligibility requirements. We reserve the right to request proof of age at any time and to terminate any Account where eligibility cannot be verified.
§3. Services Provided
The Service Provider provides electronic services to Users, including:
- Creating and maintaining a User Account;
- Access to the Afterglow game world, including exploration, combat, crafting, resource gathering, questing, and character progression;
- Participation in the player-driven marketplace and economy;
- In-game communication features;
- Optional Subscription and cosmetic purchase services;
- Access to a read-only game API (when available).
The agreement to use the Service takes effect upon successful registration. The agreement is concluded for an indefinite period. The User may terminate this agreement at any time by deleting their Account as described in §12.
The Service Provider is entitled to modify, expand, reduce, or discontinue any aspect of the Service, including game mechanics, content, features, and server availability, at its reasonable discretion.
§4. Account Registration and Security
4.1 Registration
Users register individual accounts through the Application. Registration may be performed via email, a third-party authentication provider, or other methods made available by the Service Provider.
4.2 Account Restrictions
- You may only create and maintain one (1) Account unless explicitly permitted otherwise.
- You must provide accurate and truthful information during registration and keep it up to date.
- Automated account creation (bots, scripts, or other automated means) is prohibited.
- You are solely responsible for maintaining the confidentiality of your Account credentials.
- You are responsible for all activity that occurs under your Account.
4.3 Account Ownership
All Accounts are the property of the Service Provider. You do not own your Account. You are granted a limited, personal, non-transferable, non-exclusive, revocable license to use your Account solely for your private, non-commercial entertainment purposes and in accordance with these Terms.
4.4 Account Transfers
You shall not sell, gift, trade, transfer, lend, or otherwise assign your Account to any third party. You shall not purchase, accept, or acquire any Account from any third party. Any attempted transfer is void and may result in immediate termination of all Accounts involved.
§5. Virtual Content and Ownership
5.1 No Ownership of Virtual Content
When you acquire, earn, craft, trade, or purchase Virtual Content — including but not limited to in-game currency, items, equipment, blueprints, characters, character skills, skins, cosmetics, and Subscription benefits — you receive only a limited, revocable license to use that Virtual Content within the Service. You do not acquire any ownership interest whatsoever in any Virtual Content, regardless of any effort expended or consideration paid.
5.2 No Real-World Value
Virtual Content has no real-world monetary value. You may not sell, trade, or exchange Virtual Content for real-world money, goods, or services outside of the game's intended systems. Real-money trading (RMT) of any Virtual Content is strictly prohibited.
5.3 In-Game Marketplace
The Service includes an in-game player-driven marketplace where characters may trade items and currency with other players using the game's built-in systems. This is the only authorized means of exchanging Virtual Content between Users. The Service Provider is not a party to player-to-player transactions and assumes no liability for the outcome of such trades.
5.4 Modifications and Removal
The Service Provider reserves the right to modify, rebalance, remove, or reset any Virtual Content at any time, for any reason, including but not limited to: game balancing, bug fixes, economy adjustments, combating exploits, or discontinuation of features. No refund, compensation, or credit is owed for such changes.
5.5 Full-Loot PvP
Afterglow features full-loot player-versus-player mechanics in designated areas. Items and equipment lost through legitimate PvP gameplay are not eligible for restoration or refund. By participating in PvP areas, you accept the risk of losing Virtual Content.
§6. Purchases and Payments
6.1 Subscription Services
The Service Provider offers an optional Subscription that provides enhanced features, including but not limited to: increased skill level caps, cosmetic character customization, advanced statistics, in-game mail, and other benefits as described at the time of purchase.
Subscriptions are billed on a recurring basis at the interval selected at purchase. You authorize the Service Provider (or the applicable platform provider) to charge your chosen payment method on each billing date until you cancel.
6.2 Cosmetic Purchases
The Service Provider may offer individual cosmetic items for purchase, including but not limited to: skins, cloaks, vanity items, profile decorations, and other non-gameplay-affecting items. Afterglow does not offer pay-to-win purchases. Cosmetic purchases grant no competitive gameplay advantage.
6.3 Finality of Purchases
All purchases are final. Except as required by applicable law, no refunds will be issued for any Subscription fees, cosmetic purchases, or other payments once the transaction is completed. This includes situations where your Account is terminated for violation of these Terms.
6.4 Pricing and Taxes
All prices are listed in the applicable currency and may be subject to applicable taxes. The Service Provider reserves the right to change pricing at any time. Price changes to active Subscriptions will be communicated in advance and will take effect at the start of the next billing cycle.
6.5 Platform Payments
Payments may be processed through third-party platform providers (such as Apple App Store or Google Play). Such transactions are additionally subject to the terms and policies of the respective platform provider. The Service Provider is not responsible for payment processing errors attributable to third-party platforms.
§7. User Conduct
7.1 General Obligations
You agree to use the Service lawfully and in accordance with these Terms. You acknowledge that the Service is a shared environment and that your actions affect other Users.
7.2 Prohibited Conduct
The following actions are strictly prohibited and constitute violations of these Terms:
Exploitation and Cheating:
- Using bots, scripts, macros, automation software, or any unauthorized third-party tools to interact with the Service;
- Exploiting bugs, glitches, or unintended game mechanics for personal advantage. You are expected to report such issues promptly;
- Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Application;
- Modifying the Application client or interfering with the Service's operation in any way.
Economy and Trading Violations:
- Real-money trading (RMT): selling, purchasing, or exchanging Virtual Content, Accounts, or services for real-world money or value outside the Service;
- Deliberately manipulating the in-game economy through collusion, market manipulation, or exploiting pricing errors;
- Using multiple Accounts to circumvent marketplace restrictions or gain unfair economic advantage.
Social and Communication Violations:
- Posting or transmitting content that is unlawful, defamatory, harassing, threatening, hateful, discriminatory, obscene, or otherwise objectionable;
- Impersonating any person, entity, or Service Provider representative;
- Spamming, soliciting, or advertising within the Service without authorization;
- Engaging in stalking, bullying, or targeted harassment of other Users.
Security Violations:
- Attempting unauthorized access to other Users' Accounts, the Service's servers, or any connected systems;
- Sharing, distributing, or using malicious software, viruses, or code designed to damage or compromise the Service;
- Interfering with or disrupting the Service or servers, including DDoS attacks.
7.3 Consequences of Violations
The Service Provider may, at its sole discretion, take the following actions against Users who violate these Terms:
- Issue a warning;
- Temporarily restrict or suspend Account features;
- Remove, modify, or confiscate Virtual Content (including items, currency, and progression);
- Temporarily or permanently suspend or terminate the Account;
- Pursue legal remedies where appropriate.
The severity of action taken will be proportionate to the nature and frequency of the violation. The Service Provider reserves the right to act without prior warning in cases of severe violations.
§8. User-Generated Content
8.1 Responsibility
Users are solely responsible for all content they create, post, or transmit through the Service, including but not limited to: chat messages, character names, shop names, and any other user-submitted text or media.
8.2 Content License
By posting content through the Service, you grant the Service Provider a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the operation, promotion, and improvement of the Service. This license survives Account termination.
8.3 Content Moderation
The Service Provider reserves the right (but has no obligation) to monitor, review, and remove any user-generated content that violates these Terms, applicable law, or community standards. The Service Provider is not liable for any content posted by Users.
§9. Intellectual Property
9.1 Service Provider's Rights
All intellectual property rights in and to the Service — including but not limited to: game software, artwork, graphics, animations, characters, storylines, music, sound effects, user interfaces, game mechanics, databases, server software, and all associated documentation — are owned by or licensed to the Service Provider. These Terms grant you no rights to such intellectual property beyond the limited license to use the Service.
9.2 Limited License
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the Service solely for private, non-commercial entertainment purposes.
9.3 Content Creation and Streaming
You are permitted to create and share gameplay videos, streams, and screenshots for non-commercial and personal use, including on platforms such as YouTube and Twitch. The Service Provider reserves the right to withdraw this permission at any time by notifying the User.
§10. Disclaimers and Limitation of Liability
10.1 "As Is" Service
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Service Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components, or that any defects will be corrected.
10.2 Limitation of Liability
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to:
- Your use of or inability to use the Service;
- Unauthorized access to your Account or data;
- Loss of Virtual Content for any reason, including PvP, bugs, server issues, or Account termination;
- Conduct of any third party on the Service;
- Modification, suspension, or discontinuation of the Service or any part thereof;
- Any other matter relating to the Service.
In no event shall the Service Provider's total aggregate liability exceed the amount you have paid to the Service Provider in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.
10.3 Consumer Protection
The above limitations apply only to the extent permitted by the applicable law of your jurisdiction. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.
§11. Amendments to the Terms
The Service Provider reserves the right to amend these Terms at any time for important reasons, including but not limited to: changes in applicable law, changes to the Service or its features, security requirements, or changes in the Service Provider's business operations.
Users will be notified of material changes at least fourteen (14) days before they take effect, through an in-game notification, email, or other reasonable means.
If you do not agree to the amended Terms, you should discontinue use of the Service and delete your Account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.
§12. Account Deletion and Termination
12.1 Voluntary Deletion
You may request deletion of your Account at any time through the in-game settings or by contacting the Service Provider at [email protected]. Account deletion will be processed within thirty (30) days of the request.
12.2 Effects of Deletion
Upon Account deletion — whether voluntary or due to termination by the Service Provider — all Virtual Content, characters, progression, Subscription benefits, and any associated data will be permanently deleted. No refunds will be issued for any remaining Subscription time or purchased content at the time of deletion.
12.3 Re-registration
If your Account was terminated by the Service Provider for violation of these Terms, you may not register a new Account without the Service Provider's prior written consent. Attempting to circumvent a ban through new Account creation will result in immediate termination of all associated Accounts.
§13. Privacy and Data Protection
The Service Provider collects, processes, and stores personal data in accordance with its Privacy Policy, which is an integral part of these Terms.
By using the Service, you consent to the collection and processing of your data as described in the Privacy Policy. Users located in the European Economic Area, United Kingdom, or other jurisdictions with specific data protection laws are entitled to the protections set out in the Privacy Policy and applicable law.
§14. Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
14.2 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact the Service Provider at [email protected] and attempt to resolve any dispute informally for a period of at least thirty (30) days.
14.3 Arbitration (US Users)
If you reside in the United States: Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding individual arbitration. You agree to waive your right to participate in class actions, class arbitrations, or representative proceedings. Small claims court actions in your county of residence are exempt from this arbitration requirement.
14.4 Jurisdiction (Non-US Users)
If you reside outside the United States, disputes shall be submitted to the exclusive jurisdiction of the courts of Australia, subject to any mandatory consumer protection laws of your country of residence.
§15. Complaints
You are entitled to file a complaint regarding any irregularity in the operation of the Service within thirty (30) days of the occurrence. Complaints should be submitted by email to [email protected] and should include a clear description of the issue.
The Service Provider will acknowledge receipt of the complaint and will endeavor to respond within fourteen (14) calendar days. In cases requiring investigation, the response period may be extended, and you will be informed of the expected timeline.
§16. Miscellaneous
16.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Service and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 No Waiver
The Service Provider's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
16.4 Assignment
The Service Provider may assign or transfer these Terms and its rights and obligations hereunder to any third party. You may not assign or transfer your rights or obligations under these Terms.
16.5 Force Majeure
The Service Provider shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government action, power failures, internet disruptions, or third-party service failures.
